n order for you to serve as the Executor or Administrator of an estate, you firm must qualify within 21 days of appointment by the Court. The following people are disqualified as a matter of law under Estates Code chapter 304:
1. Anyone who has been ruled incapacitated by a Texas Court or any other Court;
2. A felon convicted under Texas law or in any other jurisdiction (unless they have had their rights restored);
3. A nonresident of Texas who has not appointed a resident agent; or
4. A person the Court finds unsuitable.
It is best practice to find out if the personal representative can qualify for a bond (if needed) prior to the hearing. Usual requirements of the surety company include no bankruptcies and positive credit history.
